Practical guide
Do I have to register my guests? RD 933/2021 explained simply
The key question is whether there is a price, consideration or compensation. Here is a clear, practical summary, with examples and a checklist.
Free visit = no registration Payment = submit data Activity = where consideration is provided
What is an âaccommodation activityâ (Art. 2.1)?
Royal Decree 933/2021 recognises accommodation activity only when there is a price, consideration or compensation. If your friends stay free of charge, with no money or other exchanges involved, you would not be carrying out accommodation activities for the purposes of these regulations.
If a âgiftâ effectively becomes regular compensation, it could be interpreted as consideration.
In two lines
- đ Friends staying free of charge: you do not need to register or submit data under Royal Decree 933/2021.
- đ Where a charge or compensation is involved: you must submit the guestsâ details to the competent authority.
Obligations where a charge or compensation is involved (non-professional activity)
Even if it is only occasional (for example, renting out your home for a few days on Airbnb):
- You must submit the guestsâ details to the relevant platform (SES Hospedajes / Mossos dâEsquadra, depending on the territory).
- You do not need to keep a computerised hotel-style register.
If there is no price or consideration, you are not covered within the legal definition â you are not subject to the obligation.
Quick examples
- Your friend stays for a weekend without paying anything â there is no obligation to submit their details.
- You rent out your flat for 4 nights for âŹ250 â you must submit the guests' details.
- They bring you a bottle of wine with no prior agreement â in principle, no consideration is provided; if it becomes a regular âbarterâ arrangement, it could be regarded as compensation.
Quick checklist
Is there money or compensation (even if it is in kind)? â Yes: submit the details. No: do not submit details.
Is it professional activity (hotel/apartments)? â As well as submitting the data, keep a computerised register.
Is it occasional, between private individuals and without payment? â not subject to the obligation.
Frequently asked questions
Does a small token or gift count as consideration?
A one-off gift is not usually regarded as consideration. If there is a pattern or tacit agreement to âexchangeâ something, it could be interpreted as compensation.
What exactly must I report if there is a payment?
Submit the guestsâ details to the competent authority (SES Hospedajes or the regional police force), not a computerised register like a hotelâs.
